WEDDING PROMOTIONS – TERMS AND CONDITIONS

1. Definitions

1.1 Bespoke Weddings (Central) Limited (‘BWCL’) operate wedding promotions resulting in the allocation of prizes in accordance with these Terms and Conditions on the website www.bespoke-wedding.com (the ‘Website’) – (the ‘Promotion(s)’).

1.2 The Promotions are open to couples planning a wedding provided that each person is aged 18 or over and the age of majority in their country of residence excluding BWCL’s employees or members of their immediate family, agents or any other person who is connected with the creation or administration of the Promotions.

2. Legal Undertaking

2.1 By entering a Promotion the couple (‘Entrants’) will be deemed to have legal capacity to do so, will have read and understood these Terms and Conditions and will be bound by them and by any other requirements set out in any related promotional material.

2.2 These Promotions are governed by English Law and any matters relating to a Promotion will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

2.3 By participating in a Promotion online via the Website, Entrants accept these Terms and Conditions and confirm that they are not breaching any laws in their country of residence regarding the legality of entering the Promotions. BWCL will not be held responsible for any Entrant entering any of the promotions unlawfully.

3. Promotion Entry

3.1 There are three categories of Promotion: Round One, Round Two, and Round Three. Entrants must take part in Round One and may enter Rounds Two and Three. Each Promotion will have specific prizes.

3.2 Availability and pricing of the Promotions is at the discretion of BWCL and will be discussed with Entrants.

3.3 In order to take part in the Promotions, Entrants will initially need to register online via the Website with BWCL. To register online Entrants will be required to provide a telephone number, a valid email address and a postcode for one of the Entrants.

3.4 Entries to each Promotion are limited to one per couple. Abuse of this limit will not be tolerated and if BWCL has reasonable grounds to believe that a couple is exceeding this limit by submitting multiple entries, it reserves the right at its sole discretion to void any entries, or to award any prize to alternative Entrants. If this is discovered after the wedding, BWCL reserves the right to recover compensation equivalent to all prizes awarded, plus its reasonable costs.

3.5 Entrants who have already booked, provisionally booked, or have a show round booked in with a participating venue directly, will not be permitted to claim a Round One Promotion.

3.6 BWCL reserves the right to refuse or disqualify any incomplete entries or if it has reasonable grounds for believing that an Entrant has contravened any of these Terms and Conditions.

3.7 To the extent permitted by applicable law (including copyright), all information and documents including written work and photographic images (the “Work”) submitted by Entrants in order to take part in a Promotion become the property of BWCL and will not be returned. For the avoidance of doubt, the Entrants agree to licence all copyrights in the Work to BWCL and the Wedding Venue and Suppliers Association (“WVSA”), for a period of 25 years without reservation or exclusion thereby enabling them to be used at the sole discretion of BWCL in the United Kingdom and elsewhere. The entrants may use the works for their own personal non-commercial and non-remunerative use.

4. Round One Promotion

4.1 To enter a Round One Promotion Entrants must express an interest to purchase a package that will include:

(a) Hire of a “WVSA” accredited wedding venue (the “Venue”) on selected dates offered by BWCL.

(b) Food and drink (Minimum guests of 50 (adult) day and 80 evening, unless stated/agreed otherwise).

(c) Accommodation (if applicable).

(d) Any upgrades.

(e) The Platinum Wedding Service.

4.2 Ten Entrants from each Venue will be selected by BWCL and contacted by a Bespoke Wedding Planner who will invite them to the Venue to conclude the details of the package referred to in clause 4.1.

4.3 At the Venue the ten Entrants (or those who attend the meeting) will be invited to enter into joint and several agreements to purchase the wedding package referred to in clause 4.1 on the terms as agreed with the Bespoke Wedding Planner.

4.4. Following the meeting mentioned in clause 4.3 to confirm their booking, Entrants must pay a non-refundable sum of £500, for 2024 dates, and £600 for 2025 dates (or such other sum as may be specified from time to time) to BWCL for the Platinum Wedding Service and conclude the agreement with the Venue for the other items contained in the package referred to in clause 4.1. as agreed with the Bespoke Wedding Planner. 5. Round Two Promotion

5.1 Entry to a Round Two Promotion is available to Entrants who have paid the non-refundable sum of £500, for 2024 dates and £600 for 2025 dates (or such other sum as may be specified from time to time) to BWCL and entered into a joint and several agreement to purchase the wedding package in accordance with clause 4.4.

5.2 To enter a Round Two Promotion Entrants must provide BWCL with a story about themselves containing a maximum of 750 characters together with access to photographs on their WVSA Wedding Website which is created and maintained by the Bespoke Wedding Planner as part of the Platinum Wedding Service.

6. Round Three Promotion

6.1 Entry to a Round Three Promotion is available to forty Entrants in a Round Two Promotion who jointly and severally agree to engage the services of four or more WVSA accredited suppliers (excluding honeymoon suppliers and on the day planning services).

6.2 All Supplier Packages quoted through Bespoke Weddings include a non-refundable arrangement fee, which is fully integrated into the Suppliers discounted package price.

6.3 The forty Entrants for the Round Three Promotion will be selected by BWCL.

6.4 To enter a Round Three Promotion Entrants must agree to BWCL using the story and photographs referred to in clause 5.2.

7. Promotion Periods

7.1 Each Promotion will run for an unspecified period.

7.2 BWCL shall, in its sole discretion, determine the period of each Promotion.

7.3 BWCL reserves the right at its sole discretion to extend the closing date of any Promotion, if for any reason any aspect of the Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of BWCL which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion. BWCL may in its sole discretion cancel, terminate, modify or suspend a Promotion, or invalidate any affected entries. In the event that BWCL closes a Promotion early, the successful Entrants may be selected from all valid and eligible entries received by BWCL prior to the date of closure, except that BWCL reserves the right, at its sole discretion, to close a Promotion early without successful Entrants. In the event that a Promotion is closed without successful Entrants, BWCL will give all Entrants the opportunity to enter an alternative Promotion.

8. Promotion Judgement

8.1 Round One Promotions – the ten Entrants from each Venue will be randomly selected by a representative of BWCL.

8.2 Round Two Promotions – the successful Entrants will be determined by an independent Panel of Judges consisting of Bespoke Wedding Planners and Venue staff.

8.3 Round Three Promotions – the successful Entrants will be determined by an independent Panel of Judges consisting of Bespoke Wedding Planners and Venue staff.

8.4 The decision of the Panel of Judges shall be final.

9. Promotion Prizes

9.1 Round One Promotion – Entrants who pay the sum and enter into the agreements referred to in clause 4.4 will receive the Venue hire free of charge on the date offered by BWCL and may, at the sole discretion of BWCL, also receive complimentary accommodation for the Entrants and/or discounted food and drink (in whole or in part).

9.2 Round Two Promotion – the successful Entrants will receive £1,000 worth of additional upgrades from their venue, which could include additional guests, food & drink upgrades/extras, or accommodation (this promotion is subject to change at the sole discretion of BWCL). The additional upgrades available will be at the venue’s discretion and where possible tailored to the winning couple’s requirements. The additional upgrades package will be in addition to the Competition minimum requirements.

9.3 Round Three Promotion – the successful Entrants in the third promotion will receive a WVSA accredited supplier package free of charge which will consist of goods and/or services offered (at their sole discretion) by the four or more WVSA accredited suppliers whose services have previously been engaged by the Entrants (excluding honeymoon suppliers and on the day planning services). The value of the prize is deducted from the balance of the contractual amount payable to the suppliers.

9.4 BWCL will attempt to contact successful Entrants using the telephone number and email address provided at the time of entry (or as subsequently updated). It is the Entrants’ sole responsibility to check and update these details. If for any reason they are taken down incorrectly, BWCL will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.

9.5 If for any reason BWCL is unable to contact successful Entrants within 5 days (which may be extended at the sole discretion of BWCL) of the end of a Promotion or the Entrants fail to confirm acceptance of the Round Two or Round Three prize or the Entrants are disqualified as a result of contravening any of these Terms and Conditions, the successful Entrants will forfeit the prize and it will be awarded to the Entrants identified as the Runner Up selected in the judging process. For the avoidance of doubt once the prize has been forfeited the original successful Entrants or Runners Up will have no further claims against BWCL.

9.6 Each prize must be accepted as awarded and is non-transferable (unless where BWCL has approved a change of venue for a Round One Promotion) or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers, offers or discounts of BWCL or other WVSA suppliers.

9.7 Round One Promotion winners who have submitted a request to BWCL to change venue, should not contact any venues they wish to transfer to in the interim. The transfer must be approved by BWCL and any direct contact the Round One Promotion winner has with the venue may hinder the transfer being approved.

10. Winners’ Personal Details

10.1 All successful Entrants will be required to provide photographs and/or pose for photographs (and sometimes videos), which may be used in future marketing and public relations by BWCL in connection with the Promotions and in identifying them as a participant in a Promotion, unless prohibited by law (including copyright). All such photographs and videos (the “Work”) become the property of BWCL and will not be returned. For the avoidance of doubt, the Entrants agree to licence all copyrights in the Work to BWCL for a period of 25 years, without reservation or exclusion thereby enabling them to be used at the sole discretion of BWCL in the United Kingdom and elsewhere. The entrants may use the works for their own personal non-commercial and non-remunerative use.

10.2 By entering a Promotion, Entrants agree to the use of their name, town/county of residence, and/or photograph or other likeness as required by and at that the sole discretion of BWCL.

10.3 By entering a Promotion, Entrants agree to their personal appearance at publicity events, such as a cheque presentation, arranged by BWCL without any compensation. Such events will be organised by BWCL and the Entrants will be given reasonable notice of the date, time and venue, such attendance not to be unreasonably refused.

11. Limits of Liability

11.1 BWCL makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of BWCL, BWCL shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by BWCL, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the successful Entrants and, where applicable, to any family/persons accompanying the Entrants, or in connection with any of the Promotions offered by BWCL.

11.2 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes.

11.3 BWCL shall use its best endeavours to award the prize for a Round Two or Round Three Promotion to the correct Entrants. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, BWCL reserves the right to reclaim the Promotion prize and award it to the correct Entrants, at its sole discretion and without admission of liability.

11.4 BWCL shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due.

11.5 For the avoidance of doubt, BWCL administers the Platinum Wedding Service and acts as an intermediary only for the purposes of organising Win a Wedding Competitions (the “Bespoke Competitions”) and exclusive offers. BWCL does not provide any of the related services (the “Wedding Services”), including:

• Wedding Planning Service, provided by Freelance Bespoke Wedding Planners;

• Wedding Insurance, provided by a third-party Insurance Provider;

• Wedding Website, provided by a third-party Website Provider and personalised and maintained by the Freelance Bespoke Wedding Planners. Please note- wedding websites and all pertaining data will automatically be deleted 6 months after the wedding has taken place;

• Supplier Exclusive Discounts, provided by WVSA Accredited Suppliers and administered by the WVSA and Freelance Bespoke Wedding Planners; or

• Competition Administration and Co-ordination, provided by the WPTS, WVSA, Freelance Bespoke Wedding Planners, and third-party Sales & Marketing Consultant.

The Wedding Venues and/or Suppliers, and not BWCL, are:

• the sellers, suppliers and/or providers of the facilities and/or services;

• the party who contracts with the Entrants when the event, offers or competitions are redeemed; and

• solely responsible for providing the Entrants with its facilities and/or services.

BWCL does not provide any warranty or guarantee concerning the completeness, fitness for purpose or legality of the Wedding Services. BWCL is not liable for the quality, safety, usability or any other aspect of the Wedding Services.

12. Data Protection Notice

12.1 Any personal data that Entrants supply to BWCL or authorise BWCL to obtain from a third party, for example, a credit card company, will be used by BWCL to administer the Promotions and fulfil prizes where applicable. In order to process, record and use Entrants’ personal data BWCL may disclose it to (i) any credit card company whose name is given by Entrants; (ii) any person to whom BWCL proposes to transfer any of BWCL’s rights and/or responsibilities under any agreement BWCL may have with Entrants; (iii) any person to whom BWCL proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of BWCL in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose Entrants’ personal data BWCL may need to transfer such information outside the United Kingdom, in which event BWCL is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
